Welcome to RJS&B Enterprises, Inc. (RJS&B) and Time4Fishing.com. 
Our service has been created to be easily accessible to all users of legal age, but it also has limitations and risks that you must be aware of before participating. RJS&B provides its service to you, subject to the following Terms of Participation, which may be updated by us from time to time without notice to you. You can review the most current version of the Terms of Participation at this site. By using the services provided by RJS&B, you are accepting these Terms.

TERMS OF PARTICIPATION

1. RJS&B makes every effort to avoid errors in advertisements. However, mistakes do slip through. We ask, therefore, that you check your ad, and if you find an error, report it to Customer_Service@Time4Fishing.com immediately by email. We regret that we cannot be responsible for the portion of the ad that is in error if you do not call the error to our attention. We will attempt to correct errors within 10 days of notification, but do not guarantee correction.  Thank you.

2. Buying and selling through RJS&B is available only to individuals who can form legally binding contracts under applicable law. This excludes in all persons who have not reached their eighteenth birthday (“minors”). In addition, minors may not place or respond to a personals advertisement.

3. RJS&B reserves the right to modify the Terms of Participation at any time and without prior notice to its Users. We may add to, change, delete or end Your use of our service at any time. The service may be temporarily unavailable from time to time for maintenance or other reasons.

4. RJS&B is not involved in any transaction between any party who uses our site. There are risks which You assume when dealing with people who might be acting under false pretenses; all of these risks are borne by You. You acknowledge that RJS&B does not pre-screen content, but that RJS&B and its designees shall have the right (but not the obligation) in their sole discretion to refuse or move any content that is available via the Service. Without limiting the foregoing, RJS&B and its designees shall have the right to remove any content that violates the Terms of Participation or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content. In this regard, you acknowledge that you may not rely on any content created by RJS&B or submitted to RJS&B. We cannot control whether or not Users of RJS&B will complete the transactions they describe on our site. IT IS EXTREMELY IMPORTANT THAT YOU USE CARE THROUGHOUT YOUR DEALINGS WITH OTHER PEOPLE ON THIS SITE! RJS&B does not assume responsibility for the content or context of the user comment areas or any advertisements and information presented on our site.

5. If there is a dispute between participants on this site, RJS&B is under no obligation to become involved. In the event that You have a dispute with one or more Users, You hereby release, RJS&B's, its officers, employees, agents and successors in rights from all claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and/or our service. To the greatest extent permissible, You expressly waive the right to assert any rule of law which provides that a general release may not extend to claims a person does not know or suspect to exist at the time of execution of such general release. If You are a California resident, You waive California Civil Code Section 1542, which says "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor."

6. The RJS&B service may be used only for lawful purposes. Transmission, distribution or storage of material or conduct in violation of any applicable local, state, federal or foreign law or regulation is prohibited. This includes without limitation any unauthorized use of material protected by patent, copyright, trademark or other intellectual property right, material that is obscene, defamatory or libelous, constitutes an illegal threat, or violates rights of privacy or publicity, or violates export control laws. You may use the information on our site only to the extent necessary to facilitate RJS&B related transactions. Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.

7. RJS&B prohibits the transmission, distribution or posting of unwanted or offensive content. Prohibited transmissions include without limitation, profane or sexually explicit advertisements that include masking or misspelling the words, or images that would be illegal in any jurisdiction. It is Your responsibility, and you agree to comply with all requirements, legal or other. Additional prohibitions include misleading offers, "bait & switch" of products, telephone numbers, the sale or distribution of firearms, weapons or controlled substances, make-money fast schemes, pyramid or chain letters, fraudulent or criminal offers including but not limited to registering another email address other than your own, any posting with the goal of harassment of another, sexual requests from or for a minor, racial slurs or comments, harassment, placing a fraudulent ad. Further, RJS&B prohibits the transmission, distribution or posting of any matter which discloses unauthorized personal or private information concerning any person or entity, including without limitation phone number(s) or addresses, credit or debit cards, calling card, User account numbers/ passwords or similar financial information. Even though all of this is strictly prohibited, there is a small chance that You might become exposed to such items and You further waive Your right to any damages from RJS&B related to such exposure.

8. RJS&B prohibits the listing or sale of the following goods for any reason, including but not limited to any item that is illegal to sell under any applicable law, statute, ordinance or regulation including the following: Food, Alcoholic beverages, Firearms, explosives or ammunition, Cigarettes or any other tobacco product for human consumption, Pharmaceuticals or any other controlled substance, Dangerous, counterfeit or stolen goods, Gambling items (lottery tickets, sweepstakes, pyramid schemes, grab bags, raffles, etc.), Goods which do not actually exist, Any good that infringes or violates anyone's rights, Live animals, Human bodies, body parts or bodily fluids, Any item which in RJS&B's sole discretion is inflammatory, offensive or otherwise inconsistent with RJS&B's standards of business ethics, Any messages, data, or images that might be considered by a reasonable person to be obscene or which contain racial, ethnic, religious slurs or derogatory epithets, or advocating violence, hate or other language that is deeply or widely offensive.

9. RJS&B strongly opposes SPAM, which floods the Internet with unwanted and unsolicited email and deteriorates the performance and availability of the RJS&B service. All forms of SPAM, and all activities that have the effect of facilitating SPAM, are strictly prohibited

10. RJS&B also prohibits the use of another Internet service to send or post SPAM to drive visitors to Your site hosted, whether or not the messages were originated by You, under Your direction, or by or under the direction of a related or unrelated third party.

11. If RJS&B, in its sole discretion, determines that a violation of the Terms of Participation has occurred, RJS&B may pursue any of its legal remedies, including but not limited to the immediate deletion of any offending material from its site, cancellation of Your account and /or the exclusion of any person(s) who may have violated any Terms of Participation. RJS&B may also pursue violators with claims that they have violated various criminal and/or civil laws as applied by the relevant jurisdiction. RJS&B will cooperate with any investigation by any Federal, State, or local body or any court or tribunal legitimately exercising it's rights. Such cooperation may be without notice to You. If RJS&B believes in its sole discretion that any ad may create liability for RJS&B, RJS&B may take any actions that it believes are prudent or necessary to minimize or eliminate its potential liability, including but not limited to, the release of User information. RJS&B reserves the right to refuse service to anyone at any time, and to remove any listings or any advertisements for any reason, and without notice.

12. User understands and agrees that User is responsible for all applicable taxes and for all costs that are incurred in using the RJS&B service. We may also, in our sole discretion, add or delete fees associated with the Service from time to time without notice. There may be a charge associated with employment listings or Business Opportunities.

13. YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

(a) YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. RJS&B EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

(b) RJS&B MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

(c) ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

(d) NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM RJS&B OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS OF PARTICIPATION.

14. LIMITATION OF LIABILITY - YOU EXPRESSLY UNDERSTAND AND AGREE THAT RJS&B SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF RJS&B HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (a) THE USE OR THE INABILITY TO USE THE SERVICE; (b) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (c) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (d) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (d) ANY OTHER MATTER RELATING TO THE SERVICE.

15. EXCLUSIONS AND LIMITATIONS - SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS OF SECTIONS 17 AND 18 MAY NOT APPLY TO YOU.

16. You agree that RJS&B, in its sole discretion, may terminate your password, account (or any part thereof) or use of the Service, and remove and discard any Content within the Service, for any reason, including, without limitation, for lack of use or if RJS&B believes that you have violated or acted inconsistently with the letter or spirit of the Terms of Participation. RJS&B may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this Terms of Participation may be effected without prior notice, and acknowledge and agree that RJS&B may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that RJS&B shall not be liable to you or any third-party for any termination of your access to the Service.

17. You give us a non-exclusive, worldwide, royalty-free, irrevocable, sublicenseable (through multiple tiers) right to exercise all copyright and publicity rights, in any existing or future media, known or unknown, over the material or User Data displayed in Your listings. For the purpose of this Agreement, "User Data" shall mean all information (if any) submitted by You, (the "User") to RJS&B with the exception of trading data, credit card numbers, checking account numbers, etc. "Individually Identifiable User Data" shall mean that subset of "User Data" which can be reasonably used to identify a specific individual such as their name, address, phone number, etc. The User Data shall be deemed to be the property of RJS&B. You shall take all reasonable efforts to ensure that it is accurate and complete and not misleading in any way.

18. Others' Information. You agree not to make use of anyone else's Information other than as necessary to complete any RJS&B transactions in which You are involved.

19. Notice. Any notice to You or to us shall be made by either email or regular mail. We may also give notice of changes to these Terms of Participation or other matters related to RJS&B by displaying notices to Users on the Service.

20. This Agreement shall be governed and interpreted under the laws of the state of North Carolina, without regard to its conflict of laws provisions. Any action brought in connection with this Agreement shall be filed within one year of the date of the alleged injury, regardless of any statute of limitations, and the exclusive venue for any action shall be the General Court of Justice, Superior Court Division, State of North Carolina, County of Wake or U.S. District Court for the State of North Carolina, Eastern District, 4th Judicial District.

21. The failure of RJS&B to exercise or enforce any right or provision of these Terms of Participation shall not constitute a waiver of such right or provision.

22. You agree to indemnify, defend and hold RJS&B, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post to or transmit through the service, your use of the service, your connection to the service, your violation of the Terms of Participation, or your violation of any rights of another.

23. In the event that any court, administrative agency, arbitrator or other tribunal invalidates any provision of this Agreement, the remaining provisions shall continue in full force and effect and this Agreement shall be construed in all respects as if the invalid or stricken provision were omitted._________________________________________
